New Delhi: IRCON International Limited has approached the Uttarakhand High Court in Nainital, challenging a GST notice involving alleged wrongful availment and utilisation of Input Tax Credit (ITC) worth Rs 72.41 crore.
In a regulatory filing dated 26 October, 2026, the state-owned infrastructure company said the notice was issued by the Joint Commissioner of the CGST Audit Commissionerate, Dehradun. It seeks an explanation for alleged inadmissible ITC amounting to Rs 72,41,05,710.
Dispute Relates to Works Contract Services
The tax department's allegation concerns ITC claimed against invoices for works contract services supplied by subcontractors. The disputed amount is approximately Rs 72.41 crore.
IRCON has challenged the notice before the High Court, contesting the tax department's allegations.
Court Sets Timelines for Replies
During the initial hearing on 26 October, the High Court directed the GST department to file its counter-affidavit within four weeks. IRCON was asked to submit its reply to the show-cause notice within two weeks.
The court also directed the tax authority not to pass a final order in the matter until the next date of hearing.
The case remains pending before the Uttarakhand High Court. The interim direction prevents a final order by the tax authority for now, while giving both sides time to present their responses.
